Question: #3: How reliable is legalzoom.com?
Has anyone had documents made and actually putinto use? I was told that many estate lawyers usesimilar forms and essentially fill in the blanks. My situation is not overly complicated. We have 1rental property and 1 primary residence. We haveone child and one on the way. I was planning onusing legalzoom.com once the last child is born tocreate a will and living trust. Any advise? - asked by Rez

The difference between you entering data on blanklines and an attorney doing that is that theattorney went to law school, and, theoretically, knows what belongs and what doesn't.Legalzoomworks fine... as long as you know the rightinput.Just like tax prep software, it works greatif the input is good. Otherwise, garbagein/garbage out. There is no substitute forknowledge - answered by: kckid2

Question: #4: Im starting my own business and I need to know iflegalzoom.com is good for.....?
for trademarking a name and stuff like that. Theyare cheaper than a lawyer but should i go withthem or just get a lawyer aournd where i am Thanks - asked by Kim S

Trademarking is a highly specialized field andincludes both common law rights and statutoryrights. How those rights are preserved and whatyou must do to protect your mark is something thatonly an attorney board certified in that area cananswer based upon facts presented.Buying "forms"from legal zoom or any other such site will donothing to preserve your rights. To find a boardcertified attorney in trademark, patents orcopyrights call your local stateboard/bar.Finally, for simple filings such as LLC,Inc. filings etc. a on line form seller may befine but your situation is in a highly technicalfield. - answered by: AnswerMan4147

Question: #5: has anyone had legal issues using legalzoomdocuments in courts and/or various states?
I believe this to be a great service. However, I'mwanting to know if anyone has used these documentsin a court system and if they experienced anyproblems with the documents. - asked by jbl9950

I have never used legalzoom, but I do know thatthere are a lot of these companies that prepare"legal" forms for wills, and trusts, and othersuch legal documents, and have a large potentialto cause legal disputes. Legalzoom is one of thesecompanies. There are problems with suchstandardized forms, particularly in the case ofwills. In most states there are two forms ofwills. One that is formalized (usually where alawyers writes the will for you after you tellthem what you want the will to do, and you sign itin front of witnesses who also sign it), and onethat is halographic (meaning in your ownhandwriting). If you use one of thesestandardized forms but do not go through theformal process that's required in your state, yourwill can be considered invalid (which basicallymeans you died without a will). It will not beconsidered a formalized will. So then in that casethe form is completely useless. Sometimes, thenin some states, the court will consider the will ahalographic will (which doesn't require all thatformalization) But halographic wills, must beentirely in your own hand writing (no typedrewritten words at all). Thus I suppose you couldjust take the form and rewrite the entire documentyourself by hand if you don't want to go throughthe formalized process, but I would not recommendthat. There are still problems with these "form"wills as they are sometimes called, even if youget them formalized, or entirely rewrite them, because they are not specific to your individualneeds. Everyone wants specific things in theirwill, and sometimes you may think that what youradding is for the benefit of your beneficiaries, but that can be a tricky issue of legalinterpretation. Only a lawyer can really help youfigure out what would be best for your particularsituation. They may even be able to recommendthings that you would never have found usinglegalzoom. In the end, using such a program forcomplicated legal documents, particularly wills,is a dangerous proposition, and I would avoid it. [PS Also since the "form" documents are notindividualized they can create, and do create hugelegal battles later on which are extremely costly, especially if they document relate to largeamounts of money, which legal documents often do] - answered by: Slexie

Question: #8: Are Legalzoom prepared legal documents legal inTexas.?
- asked by Seadumpowner

According to their website, the documents areprepared by "expert attorneys" so you would haveto make sure you tell them that you need itguaranteed in Texas. It says "satisfactionguaranteed" too.Frankly, though, I would justretain a Texas attorney to draw up whateverdocuments you want prepared. - answered by: Princess Leia

Question: #9: Has anyone filed divorce papers online? Legalzoom?
I want to file for an uncontested divorce online. It is a mutual split, with no property or childissues since we have none. Have any of you donethis? I know going to an attorney is a good ideaalso, but it sounds very expensive and I can'tafford that now that I am alone. Any friendlyadvice? Thanks =) - asked by seperated

When I got divorced my husband (at the time) wentto the courthouse for our county and filed fordivorce. I was served with the divorce papers, and a court date. We went to court the judgeasked a few questions and asked if there wasanything we needed to discuss. My ex said that wewere to split the bank account on the date of thedivorce, and that he was to refinance a vehicle weowned within 6 months. The judge added that tothe decree and it was done. We were very much inthe same situation and it was easy. From date offile, to date of divorce, 90 days! Just make sureanything that you decide and agree on, you writedown and ask the judge to note in the decree. Wedid it, and there were no problems. - answered by: *baby*2008*

Question: #10: Anyone used legalzoom.com to apply for a patent? Results?
Is it trustworthy? What was your experience? - asked by lynlyn70

Yes, I've used them for both provisional anddesign patents. I had a great experience with theprovisional patent process--very timely responses, great drawings and helpful staff. The designpatent has been a different story...I was toldthey replaced most of the patent dept and my orderwas backed up for months. they are not a law firmbut they do prepare legal documents....you shouldknow that when you call customer service-- theycan't answer a lot of the questions you may wantthem to because they are not a law firm. Youmust do some leg work and have a basicunderstanding of patents before you go to thesite, but they streamline the process greatly. You pay for that process, but for me it was worthit. Yes, one can go to the US Patent Officeonline and get all the forms, but I wonder howmany patents get rejected simply because formsweren't filled out correctly? So for me it wasworth it to have Legal Zoom do it. I might usethem for another provisional patent or otherthings like a will or incorporation, but I'm notsure I would do a full design patent with themagain because of the lengthy time i waited forwork to be finished and the lack of communicationabout where they were in the process of myorder. As for their trustworthiness nothing hasraised any red flags for me and I receiveddocuments via express mail as they promised &confirmation from the USPO also, so I don'tquestion their trustworthiness. - answered by: dramaticprof
